This Privacy Policy (Policy) governs the collection, use, storage, disclosure, retention, and protection of information in connection with the application (App) operated by 3K Equalizer, LLC (Operator, we, us, or our), available through our website and mobile applications. This Policy applies to information processed through the App and related services, features, content, and communications that link to or reference this Policy (collectively, Services). By accessing or using the App, you (User or you) acknowledge that you have read and understood this Policy and consent to the processing of information as described herein to the extent consent is required under applicable law. If you do not agree, do not access or use the App.
We may change this Policy from time to time. We will post the updated Policy within the App or otherwise make it available through the Services. Changes are effective upon posting unless otherwise stated. Your continued use of the App after the effective date constitutes acceptance of the updated Policy. We encourage you to periodically review the Policy to stay informed about our information practices.
3.1 We may collect the following categories of information through the App:
a. Information you provide: Information you submit through the App (for example, when you contact support or submit content through App features, when you create an account; edit your profile; upload content or comments; fill out a form or survey). The types of information we may collect in this manner include basic contact information, location, date of birth, and demographic information you provide to us.
b. Information collected by Third-Party Analytics Providers: We may work with Third-Party Analytics Providers to collect demographic data and information relating to App and internet usage to analyze performance and improve the Services. Such providers may use cookies or similar technologies as permitted by your device settings and applicable law.
We use information collected through the App for the following purposes: To provide, operate, maintain, and improve the App and Services, including troubleshooting, performance monitoring, and feature development. To evaluate App usage, compile reports on activity, and analyze performance metrics, including through Third-Party Analytics Providers. To secure the App and our systems, including detecting, preventing, investigating, and responding to security events, malicious software, fraud, abuse, or unauthorized access. To administer access to the App and related systems, including provisioning, changing, and terminating access as appropriate. To comply with applicable federal law, lawful requests, and to enforce this Policy and other applicable terms.
5.1 We will not sell or rent your Personal Information. We may disclose information as follows:
a. Service Providers: To Service Providers that support the Services, subject to contractual obligations to protect information and use it only for authorized purposes.
b. Third-Party Analytics Providers: To Third-Party Analytics Providers to evaluate your use of the App, compile reports on activity, and analyze performance metrics. You consent to such processing to the extent required by applicable law.
c. Legal and safety: To comply with federal law, regulation, legal process, or governmental request; to protect the rights, property, or safety of Users, the Operator, or others; and to investigate or prevent suspected or actual wrongdoing.
d. Business continuity: In connection with a corporate transaction (for example, merger, acquisition, reorganization, or sale of assets), subject to continued protection consistent with this Policy.
5.2 3K Equalizer, LLC is not a “covered entity” as those terms are defined under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). Therefore, HIPAA’s privacy and security requirements do not apply to us. Nevertheless, we safeguard your consumer health data in accordance with applicable laws and this Privacy Policy.
We may use third-party analytics services to evaluate your use of the App, compile reports on activity, collect demographic data, and analyze performance metrics. These third parties may use cookies or similar technologies to help analyze and provide data. You may be able to opt out of certain data collection by adjusting your device settings, limiting ad tracking where available, or using any opt-out mechanisms made available by the applicable analytics provider. If you opt out, some App functionality may be limited.
The App may contain third-party advertising and links to third-party websites. We are not responsible for the privacy practices or policies of these advertisers or websites. We hereby expressly disclaim, and you hereby expressly release us from, any and all liability whatsoever for any controversies, claims, suits, injuries, harm, loss or damages, arising from or in any way related to third-party advertisers, or the use of links to third-party websites that may appear on the App, including, but not limited to, such websites’ availability, privacy policies, content, advertising, and products or other materials.
The Children's Online Privacy Protection Act (COPPA) regulates the online collection of personal information from children under the age of 13. 3K Equalizer is not directed to children generally, but accounts for athletes under the age of 13 are permitted where a parent or legal guardian has first completed and signed a parental consent form authorizing their child's use of the App and our collection of the child's personal information. We do not knowingly collect personal information from a child under 13 unless we have received such signed parental consent. If we learn that we have collected personal information from a child under 13 without the requisite signed consent, we will take steps to delete that information or obtain the necessary consent as soon as reasonably possible. Parents or guardians may review, correct, or delete their child's information directly within the App, or by contacting us at support@3kequalizer.com.
9.1 We take reasonable measures in an attempt to help protect information about you from loss, theft, misuse, and unauthorized access, disclosure, alteration and destruction, including, without limitation, encryption, and passwords. However, no method of transmission or storage is 100% secure; therefore, we do not represent or warrant that your information will be absolutely secure.
9.2 You are advised and encouraged to take any and all necessary steps to protect against unauthorized access to your devices, computers, and passwords by taking your own security measures. We are not responsible for the unauthorized use of your information, nor for any loss, stolen, or compromised user identification logins or passwords.
We retain your information for as long as your account remains active. If your account becomes inactive, we queue your account and associated information for deletion after a period of approximately 18 months of inactivity. We may retain information for a longer period where necessary to preserve the integrity of our databases, comply with our legal obligations, resolve disputes, or enforce our agreements.
Depending on where you live, applicable state privacy laws may give you certain rights over the personal information we hold about you. Where applicable, and subject to certain exceptions and limitations under applicable law, these rights may include the right to: know what personal information we have collected about you and how it has been used and disclosed; access a copy of that information; correct inaccurate information; delete personal information we have collected from you; opt out of the sale or sharing of your personal information; and not be discriminated against for exercising any of these rights. As described in Section 5.1, we do not sell or rent your Personal Information. You may delete your account and associated information directly within the App, or exercise any of these rights by contacting us at support@3kequalizer.com. We will respond to verifiable requests as required by applicable law.
